The Three Legal Traps
What costs foreign buyers dearly — and how to avoid them
Spain's legal framework protects buyers — but only those who know how to use it. These three traps account for the majority of post-acquisition losses among international buyers.
No Independent Legal Representation
The scenario: Many buyers rely on the seller's lawyer or the agency's recommended lawyer. In Spain, the notary validates the transaction — not your due diligence. The notary does not protect the buyer.
The consequence: Hidden debts, IBI arrears, unpaid community fees, and undeclared structural modifications all transfer to the new owner at signature.
The solution: Appoint your own independent abogado — one with no connection to the seller, agency, or developer. This is non-negotiable.
Signing Arras Too Early
The scenario: The arras contract (10% of purchase price) is binding. Many buyers sign under time pressure — 'another buyer is interested' — before legal checks are complete.
The consequence: Withdrawing costs €100,000–300,000 on a €1.5–3M property. Proceeding means inheriting the legal problem.
The solution: Never sign an arras until the nota simple, ITE structural report, and community debt certificate are reviewed and clean. A reputable seller will wait 5–7 working days. If they won't — that itself is information.
Underestimating Acquisition Costs
The scenario: Foreign buyers consistently underestimate the full cost of acquisition in Spain, leading to liquidity surprises at signing.
The consequence: ITP (Property Transfer Tax — Catalonia): Up to €600K: 10% · €600K–€900K: 11% · €900K–€1.5M: 12% · Above €1.5M: 13%. Notary fees: 0.1–0.5% · Land registry: 0.1–0.3%
The solution: Budget a minimum of 12–15% above the agreed price from day one. On a €2M property, that means approximately €240,000–300,000 in additional liquidity at signing. Most buyers are surprised by this figure. You should not be.
